With the advent of adding up disability, it’s important to understand how the WCAB has gone from adding impairment in Kite, to formalizing the formula in Vigil, to now applying that formula in Vigil’s progeny. This webinar will take a look at how and why the WCAB is allowing injured workers to rebut the CVC and what carriers can do to minimize its impact. Starting with Kite and then Vigil, this webinar will review the recent cases that have applied the theory that adding impairment is more “accurate” than using the combined values chart for permanent disability. This will be followed by a short Q&A session to further explore how to best defend against this rebuttal of the CVC.
